Microsoft filed a motion Wednesday night asking a federal appeals court to overturn last December's temporary injunction that bars the company from bundling Internet Explorer with Windows. The reason? Microsoft is hoping to get Windows 98 out the door on schedule and Windows 98 does not include a separate version without Internet Explorer.
"In order to comply with the preliminary injunction insofar as it relates to Windows 98, Microsoft would have to create a whole new operating system that did not provide support for Internet standards," Microsoft wrote in a brief filed with the court.
Windows 98 is due to ship to hardware manufacturers on May 15 so that they can bundle it with new computers in time for a June 25th release date to the public.
