Judge Approves Microsoft's California Antitrust Settlement

A superior court judge has approved Microsoft's 2003 antitrust settlement with California, paving the way for the software giant to distribute as much as $1.1 billion worth of vouchers that the state's businesses, consumers, and schools can use to purchase computer hardware and software. The settlement affects more than 14 million consumers in California.
"\[The settlement is\] fair, reasonable, and adequate compensation," California Superior Court Judge Paul H. Alvarado stated in his 31-page decision. He dismissed all the objections that various Microsoft competitors have raised and ended any chance that the disputed settlement could go to trial.
Consumers in California filed their class-action suit against Microsoft in 1999 after a federal court found the company guilty of overcharging individuals for Windows and Microsoft Office. The settlement covers software purchased between February 1995 and December 2001. California's Microsoft settlement is similar to the agreements that the company struck in 13 other states, although it is, by far, the largest.
California plaintiffs now have 75 days to file claims, and more than 600,000 people have already done so, according to lawyers who tried the class-action suit. The state will use two-thirds of the unclaimed portion of the settlement amount to purchase computer equipment and software for California's poorest schools.
